Virginia DUI Laws: A Refresher

Parties and social occasions are plentiful during the holidays and on New Year’s Eve—unfortunately so are the risks associated with driving under the influence, or DUI.

 

How much do you have to drink for a DUI in Virginia? If you’re 21 or older, your blood alcohol content limit is .08 percent.

 

For a 120-pound person, that’s about three drinks. For someone who’s 200 pounds, that’s about five drinks. Of course that depends on a variety of factors specific to your body and your circumstances—including how big your drinks are. These estimates are based on a drink being one beer, one 3-ounce glass of wine, or 1 oz. of hard liquor.

 

What happens if you’re convicted of DUI? With your first conviction, you can go to jail for 5 days if you have a passenger under age 18 in the vehicle. You can also go to jail for 5 days if your blood alcohol level is .15–.20, or for 10 days if it’s above .20.

 

There is a minimum $250 fine, you can have your license suspended for one year, and you will need to complete an alcohol safety action program. If your blood alcohol level is .15 or over, you will also be restricted to driving a vehicle with an ignition interlock device.
